    I am NOT proud of this...but it happened. I fell into hard times a few months ago, almost ended up homeless, and had to take out 3 seperate pay-day loans for a total of $1,600.00 combined. I was doing great there for awhile, paying the roll-over fees every two weeks, but it got to the point where I was falling behind on my other bills and we did not have enough money for gas, food, and our utilities. Finally I said screw it...I stopped paying on them. All the checks went to the bank...now I'm almost $3,000.00 in debt. This is considered bad check writing and fraud, and I know I can go to jail for this.(I am able to make partial payments to these places, but since I was told that doing so would not stop addtitional fees and collection/legal proceedings, I chose not to--simply because I would rather use that money for food or gas if they're gonna still try to come after me, anyways!) I know I've been reported to Chexsystems already, but what I really need to know is if they've already issued me a warrant?? it would suck big-time to discover this after getting pulled over by the cops for something dumb, like a tail light or speeding ticket...so is there anyone I can call discreetly to look up this info for me? And what should I do about my situation? Yes I know...I'm extremely dumb and this is all my fault. I just need some good advice. Thanks.

    First of all, if they were to issue warrants for those who have fallen behind in their pay day loans, Colorado would have to build a prison to hold 1/3 of the state. A warrant would only be issued if you altered, printed, or stole checks and cashed them. Overdrafts do not constitute criminal procedures, it just gets you reported through Chex system. Also did you know that in Colorado as of Mar 18, 2007, prohibits lenders from re-depositing a check that bounces more than twice to rack up those $25 bad check charges. All you can do is try to get them paid off quickly and never never use them again unless you know for certain that you can pay it off with just one check.     That happened to me before.. I had a payday loan with a local company and was unable to pay it.... It didn't even go on my credit. It is reported to some kind of payday loan agency that will be in the system that will not allow you to get a payday loan. That what they say.. But, I was approved for several online payday loans. But, no jail. No warrants. They can try to collect the debt and pursue it in harassing you even though debt collectors are not suppose to harass.. Get some rest, it's al good! it has been almost eight year now and my husband and I both couldn't repay the loans. They just have to write them off as a lost.

    These matters are civil, not criminal, so you're not going to have a warrant issued for your arrest unless they can show you actively committed fraud, which is very hard to do. Now before people go and reply, I'm very aware that you have to write these payday loan people postdated checks. I'm not sure off the top of my head what the law is, but the courts have ruled that post dated checks that bounce (especially with pay day loan companies) is not considered a crime. At worst, you might face a civil lawsuit for the debt but you will not be facing any criminal charges.

    Those are tactics by collectors and they are highly illegal. You should first check on the companies, such as {CITY} & Associates, Ace Express, etc. Google it. You are correct about them getting your a WRITTEN proof over the mail.. DO NOT VOLUNTEER any information over the phone. If this is a legitimate loan, they will have all your information. No financial company can have you arrest for owing money. So, don't worry about. Keep on mind, that this could be a scam or identity theft. Check your credit score from all three companies to see if it appears in on of them. Then file for identity theft.

    Your best bet is to simply talk to the cash advance places & arrange for a smaller payment schedule. You won't be able to take out any more loans from payday advance places, but you'll know that you are taking care of it. They're all loan sharks, but a few of them are actually willing to work with you on the payments. They want to get their money. (A friend of mine used to work at a payday advance place in Colorado & in these situations the company would be a little lenient as long as the customer was making some sort of payment towards the outstanding balance.) As for the warrant, ask the police station directly. If they *do* have a warrant out for you, the best thing for you to do is to go ahead & go to the police department. If you turn yourself in & show that you are trying to pay off the outstanding balance, the judge is more likely to show clemency. If the police have to track you down & drag you in, the court system isn't going to show you any mercy.

You can screw payday lenders over day in and day out and they literally have ZERO recourse as law enforcement will do NOTHING for them even for FRAUD loans....bottom line is the government thinks they are the scum of the earth and will not back them on a thing! I have worked in management for several payday / title loan lenders here in Colorado and I have seen it all .... heck last week a guy pawned a fake title on me on a truck he didn t even own! I gave him $7k check which he cashed and spent.....after we found out the loan was fraud, we went to the police and they laughed and said "It s about time someone screws you guys over!" This goes for payday loan lenders only as if you do anything fraudulent w/ an FDIC insured bank or lender you will be prosecuted...trust me. Just my FYI. Thanks!
